By Ashley Robinson Bill Cosby is not currently in prison. He was released from a Pennsylvania state prison on June 30, 2021, after the Pennsylvania Supreme Court overturned his sexual-assault conviction and ordered his immediate release.
Cosby had served nearly three years of a three-to-10-year sentence when the court ruled that prosecutors had violated his due-process rights. The decision ended his imprisonment in the criminal case involving Andrea Constand.
Although Cosby was released, that does not mean his legal troubles ended. He has continued to face civil lawsuits and financial judgments connected to allegations of sexual assault. A civil finding of liability is different from a criminal conviction and does not automatically send someone to prison.
Why Cosby went to prison
Cosby was arrested and charged in Pennsylvania in 2015 after Constand accused him of drugging and sexually assaulting her at his home in 2004. He denied that he had committed a crime and said the sexual contact was consensual.
Cosby’s first trial in 2017 ended with a deadlocked jury. Prosecutors tried the case again in 2018, and a second jury found him guilty on three counts of aggravated indecent assault. A judge sentenced him to three to 10 years in state prison.
The conviction made Cosby one of the most prominent entertainers in the United States to be imprisoned for a sexual-assault offense. Before the case, he had been widely known as a comedian, actor, producer and television personality, especially for The Cosby Show.
Why the conviction was overturned
In 2021, Pennsylvania’s highest court ruled that Cosby should not have been prosecuted in the way the case proceeded. The justices focused on an earlier decision by former Montgomery County District Attorney Bruce Castor, who had announced in 2005 that Cosby would not be criminally prosecuted in the Constand matter.
That announcement led Cosby to give testimony in a civil case. Prosecutors later used parts of that testimony in the criminal prosecution. The Pennsylvania Supreme Court concluded that the earlier assurance had deprived Cosby of important constitutional protections and that his due-process rights had been violated.
The court vacated the conviction and barred further prosecution on those particular charges. Cosby walked out of the State Correctional Institution Phoenix in Montgomery County the same day.
Release did not mean he was found innocent
The court’s decision was based on due-process concerns. It did not declare that the allegations against Cosby were false, and it was not a jury acquittal after a new trial.
This distinction is important when describing his current legal status. Cosby’s criminal conviction was overturned, so he is not serving that prison sentence. At the same time, the Pennsylvania court’s ruling did not erase the allegations or prevent accusers from pursuing civil claims where the law allows them.
Cosby has continued to deny wrongdoing in the cases brought against him. His attorneys have argued that several proceedings were unfair and have challenged verdicts and damages awards.
Recent civil lawsuits against Cosby
Cosby’s legal problems continued after his release. In 2022, a California jury found him liable in a civil case brought by Judy Huth, who alleged that he assaulted her when she was 16. The jury awarded her $500,000.
In March 2026, another California jury found Cosby liable in a case brought by Donna Motsinger. She alleged that Cosby drugged and sexually assaulted her in 1972. The jury awarded approximately $59.25 million in damages, including compensatory and punitive damages.
Cosby did not testify at that trial, and his legal team said it planned to appeal. The verdict was civil, not criminal. It resulted in a financial judgment rather than a prison sentence.
Where Bill Cosby stands now
Cosby remains out of prison, but he continues to face legal and financial consequences. His criminal conviction in the Constand case remains vacated, while civil judgments against him may be appealed or enforced through the courts.
He has largely stayed out of the spotlight since his release, although he has occasionally appeared in entertainment and family news. In 2025, his representative also issued a statement after the death of Malcolm-Jamal Warner, who played Theo Huxtable on The Cosby Show.
The most accurate answer is that Bill Cosby is not in prison. He was released in 2021 after his criminal conviction was overturned.
